1.3 Services: Refers to all offerings provided by NAWS, including but not limited to: electronic data discovery, forensic document analysis, and reporting.
1.4 Data: Refers to electronic documents, files, emails, images, and other forms of digital evidence provided to NAWS by the Client.
2. Scope of Services
2.1 Electronic Data Discovery: We specialise in identifying, processing, and analyzing electronic documents to provide insights into document origins, file modifications, access patterns, and discrepancies.
2.2 Commitment to Authenticity: Our forensic analysts are dedicated to ensuring the authenticity and integrity of digital documents, uncovering any hidden alterations or modifications.
3. Client Responsibilities
3.1 Data Provision: Clients must provide accurate and complete information or materials required for our analysis.
3.2 Ownership Rights: Clients confirm they have the legal right to provide the data submitted to NAWS for analysis.
3.3 Compliance: Clients agree to comply with all applicable laws and regulations regarding the data they submit for forensic investigation.
4. Confidentiality and Privacy
4.1 Data Protection: NAWS will maintain strict confidentiality regarding all data submitted for analysis and will take all reasonable steps to secure it against unauthorised access.
4.2 Limited Sharing: NAWS will only disclose data or findings to the Client, unless otherwise required by law or authorised by the Client.
5. Intellectual Property
5.1 Ownership of Reports: Reports generated by NAWS are the intellectual property of the Client once payment is received in full.
5.2 Use of Findings: NAWS retains the right to use anonymised findings for research, educational purposes, or service improvement unless otherwise agreed.
6. Limitations of Liability
6.1 Accuracy of Data: NAWS is not responsible for inaccuracies or omissions in data provided by the Client.
6.2 Reliance on Findings: While every effort is made to ensure accurate analysis, NAWS does not guarantee that our findings will result in a specific outcome or legal decision.
6.3 Indirect Damages: NAWS is not liable for any indirect, incidental, consequential and/or monetary damages arising from the use of our services.
7. Fees and Payment
7.1 Service Fees: Fees for services will be agreed upon before the commencement of work.
7.2 Payment Terms: Payments must be made in accordance with the terms outlined in the service agreement or invoice.
7.3 Non-Refundable: Payments are non-refundable except in cases of service non-performance as determined by NAWS.
8. Termination
8.1 By Client: Clients may terminate services at any time, subject to payment of fees for any work already completed.
8.2 By NAWS: NAWS reserves the right to terminate services if the Client violates these terms or if the submitted data is deemed unlawful or unethical to process.
9. Dispute Resolution
9.1 Governing Law: These Terms and Conditions are governed by the laws of England and Wales.
9.2 Resolution: Any disputes arising from these terms will be resolved through arbitration or mediation, as agreed upon by both parties, with no court involvement.
10. Amendments
NAWS reserves the right to amend these Terms and Conditions at any such time. Clients will be notified of significant changes and may terminate their agreement if they do not accept the revised terms.
